Doctor takes legal action against Qld Government

The surgeon stood down from Rockhampton Hospital in central Queensland has launched legal action against the State Government claiming breaches of natural justice.

The urologist was stood down from the hospital in May amid allegations about botched surgeries, including claims he removed the wrong kidney from a patient.

The ABC can reveal lawyers for Dr Antonio Vega Vega filed an application in the Supreme Court in Brisbane today, arguing an investigation into his practice was biased.

The Medical Board of Australia had already reinstated Dr Vega Vega’s right to practise after he was cleared by the Queensland Civil and Administrative Tribunal.

But Dr Vega Vega had not be able to return to work at the public hospital in Rockhampton while the independent investigation took place.

This week, Queensland Health Minister Lawrence Springborg confirmed the investigation had been completed.

Dr Vega Vega’s lawyers said that investigation was biased and they had been prevented from accessing documents relating to 58 witnesses.

Mr Springborg said he was not sure whether the independent investigation would be released publicly.

In August, Dr Vega Vega also launched legal action in the Supreme Court in Brisbane to get his pay reinstated.

He was suspended from working at the hospital without pay.

That matter was settled out of court and the terms of the agreement were confidential.
