Perth man convicted for selling electronic cigarettes

In a landmark West Australian Supreme Court case, a man who was originally acquitted of selling e-cigarettes has been convicted after an appeal by the Health Department.

Vincent van Heerden was found guilty of breaching the Tobacco Products Control Act in April, which made WA the first jurisdiction in the world to outlaw the sale of e-cigarettes.

On Tuesday, he was sentenced in the Administrative Appeals Tribunal by Justice Janine Pritchard.

Van Heerden was convicted under the state’s Tobacco Products Control Act, which prohibits the sale of any food, toy or other product that is not a tobacco product but designed to resemble one.
